Effective Date: January 1, 2025

Article 1 (Purpose)

These terms and conditions are intended to stipulate the rights, obligations, and responsibilities between the Association and users, and other necessary matters related to the use of the PIN UP Concept Design Awards contest website (hereinafter "Site") operated by the Korea Innovation Design Association (hereinafter "Association").

Article 2 (Definitions)

  1. "Site" means the online services related to the PIN UP Concept Design Awards contest provided by the Association.
  2. "User" means members and non-members who access the Site and receive services provided by the Association in accordance with these terms and conditions.
  3. "Member" means a person who registers as a member on the Site and uses the services.
  4. "Work" means design works and related materials submitted by members through the Site.
  5. "Service" means all online services provided by the Association, including contest participation applications, work submissions, and checking of judging results.

Article 3 (Posting and Amendment of Terms)

  1. The Association posts the contents of these terms and conditions on the initial screen of the Site so that users can easily know them.
  2. The Association may amend these terms and conditions within the scope that does not violate related laws when necessary.
  3. When the terms and conditions are amended, the Association specifies the contents of the amended terms and conditions and the effective date and announces them on the initial screen of the Site together with the current terms and conditions from 7 days before the effective date until the day before the effective date.
  4. Users may request membership withdrawal if they do not agree to the amended terms and conditions, and if they continue to use the service after the effective date of the amended terms and conditions, they are deemed to have agreed to the changes in the terms and conditions.

Article 4 (Membership Registration and Account Management)

  1. Membership registration is established when a user agrees to the contents of the terms and conditions and applies for membership registration, and the Association approves it.
  2. Members must register using their own email address and cannot register using another person's information.
  3. If there are changes to the registered information, members must immediately modify their membership information.
  4. Members are responsible for managing their accounts and passwords and cannot transfer or lend their accounts to third parties.
  5. If a member recognizes that their account has been stolen or is being used by a third party, they must immediately notify the Association and follow the Association's guidance if provided.

Article 5 (Provision and Changes of Services)

  1. The Association provides the following services:
    • Contest information provision and notice posting
    • Work submission and receipt services
    • Services for checking judging progress and results
    • Award-winning work information provision services
    • All other services additionally developed by the Association or provided through partnership agreements, etc.
  2. The Association may change the contents of services and will notify in advance when changes are made.
  3. The Association may change all or part of the services provided due to operational or technical needs.

Article 6 (Work Submission and Copyright)

  1. The copyright of works submitted by members belongs to the members. However, the Association may use the works for the following purposes:
    • Contest judging and evaluation
    • Announcement and exhibition of award-winning works
    • Production of catalogs and promotional materials
    • Contest-related promotion and marketing

    Archive Preservation and Exhibition of Award-Winning Works: The Association may post information such as images of award-winning works, winner names, and affiliations on the Site's "Award Gallery (Hall of Fame)" without a set period for the purpose of preserving the historical records of the contest and proving award achievements, and has the right to reproduce, transmit, and distribute for this purpose. This is considered to have been agreed upon when participating in the contest.

  2. Members guarantee that the works they submit are their own creations and do not infringe on the copyrights of others.
  3. If a work infringes on the intellectual property rights of others, the work will be excluded from judging and all legal responsibility lies with the member.
  4. Submitted works will not be returned in any way, and modification and changes are not possible after the submission deadline.
  5. For award-winning works, additional use may be possible through separate consultation between the Association and the winner.

Article 7 (Entry Fees and Refunds)

  1. The designated entry fee must be paid to participate in the contest.
  2. The entry fee must be paid within the designated deadline after work submission, and if not paid, the work may be excluded from judging.
  3. After payment of the entry fee, refunds are not available except in the following cases:
    • Contest cancellation due to the Association's fault
    • Cases where there is a clear error such as duplicate payment
  4. Refunds due to simple change of mind by members are not available.

Article 8 (User Obligations)

  1. Users must not engage in the following acts:
    • Acts of stealing another person's information or registering false information
    • Acts of changing information posted by the Association or using information obtained through the service by copying, publishing, broadcasting, etc., or providing it to third parties
    • Acts of infringing on the copyrights and other intellectual property rights of the Association and other third parties
    • Acts of damaging the reputation of the Association and other third parties or interfering with their business
    • Acts of disclosing or posting obscene or violent messages, images, sounds, or other information contrary to public order and morals
    • Acts that may interfere with the stable operation of services
  2. If a user engages in the acts in the preceding paragraph, the Association may restrict the user's use of services or revoke membership without prior notice.

Article 9 (Restriction and Suspension of Service Use)

  1. The Association may restrict or suspend service use in the following cases:
    • Unavoidable cases due to maintenance work on service facilities
    • Cases where a telecommunications business operator specified in the Telecommunications Business Act has suspended telecommunications services
    • Cases where there is a hindrance to service use due to national emergency, service facility failure, or service use overload, etc.
    • Other cases where the Association deems it inappropriate to continue providing services due to serious reasons
  2. When the Association restricts or suspends service use in accordance with the provisions of the preceding paragraph, it will notify the reason and restriction period in advance.

Article 10 (Compensation for Damages and Exemption)

  1. The Association is exempt from responsibility for service provision when services cannot be provided due to natural disasters or equivalent force majeure.
  2. The Association is not responsible for service use obstacles due to the member's fault.
  3. The Association is not responsible for profits that members expect to gain from using the service, nor is it responsible for damages caused by materials obtained through other services.
  4. All legal responsibility for copyright infringement, plagiarism, etc. of works submitted by members lies with the members, and the Association is not responsible for this.

Article 11 (Resolution of Disputes)

  1. Lawsuits concerning electronic commerce disputes between the Association and users shall be based on the user's address at the time of filing, and if there is no address, the exclusive jurisdiction of the local court having jurisdiction over the residence.
  2. Korean law applies to electronic commerce lawsuits filed between the Association and users.

Article 12 (Others)

  1. Matters not specified in these terms and conditions follow related laws and commercial practices.
  2. The interpretation of these terms and conditions follows the detailed guidelines set by the Association.
